Power of Attorney for Property Transactions in Malaysia: Signing from Overseas

A power of attorney for Malaysia property lets you (the donor) authorise someone you trust (the donee, or attorney) to sign the SPA, the transfer and the bank documents on your behalf. In Peninsular Malaysia, including Johor, a PA used for property must be stamped and then registered at the High Court, and if you’re overseas you can sign it before a local notary public or a Malaysian consular officer. It’s convenient, but it’s a lot of power, so keep it narrow and give it to the right person.

Short answer

A power of attorney (PA) lets someone you trust sign the SPA, the transfer and the bank documents for you while you are overseas. For property in Peninsular Malaysia the PA must first be stamped at LHDN and then registered at the High Court’s power of attorney registry. Signed abroad, it can be witnessed by a notary public, a commissioner for oaths or a Malaysian consular officer.

What is a power of attorney, and when do property buyers need one?

A power of attorney is a legal document in which the donor gives the donee authority to act for them. Documents the donee signs within that authority bind the donor as if they had signed them personally. In a property deal the donee can sign the offer, SPA, Memorandum of Transfer (Form 14A), loan and charge documents, and deal with the land office and banks.

  • You live overseas: Malaysians working in Singapore or elsewhere, and foreign buyers who can’t be present for every signing.
  • The seller is abroad: selling means signing the SPA, MOT and redemption papers, and possibly a state consent application.
  • Elderly or less mobile owners: a family member handles the paperwork.
  • Co-owners: one owner is away long-term and another acts for them.

The donee can only do what the PA says. PropertyGuru notes that a donee can transfer property, sign agreements and manage finances, but can’t make or change your will, change beneficiaries or delegate the power to someone else.

Common mistake: signing a general PA “to keep things simple”. For a property transaction that’s handing someone a blank cheque. Ask your lawyer for a specific PA naming the property address and title number.
A late PA is paid for in late interest

Drafting, signing abroad, couriering, stamping and High Court registration all sit inside a subsale completion period of 3 months plus a 1-month extension, and the extension carries interest on the unpaid balance at the rate in your SPA. The other common problem is a PA drafted too narrowly, so the attorney cannot sign one document and the deal waits while it is redone.

How to register a power of attorney in Malaysia

  1. 1. Have a lawyer draft itDonor and donee details, the named property, the powers (sign SPA, MOT, loan documents, pay and receive money), the duration and any limits.
  2. 2. Sign before a qualified witnessIn Peninsular Malaysia this can be a magistrate, justice of the peace, land administrator, notary public, commissioner for oaths, advocate and solicitor, or a bank officer, among others. Signing abroad is covered below.
  3. 3. Stamp itThe PA must be stamped at an LHDN stamp office in Peninsular Malaysia before registration. If signed abroad, the 30 days run from when it first arrives in Malaysia.
  4. 4. Register it at the High CourtLodge the original and a duplicate with the power of attorney registry at the High Court in Kuala Lumpur or another High Court registry in Peninsular Malaysia.
  5. 5. Hand it to your lawyerWhen the donee signs property documents, the lawyer attaches a certified copy of the registered PA. Ask your lawyer in advance whether the land office, bank or other side’s lawyer needs anything more.
What I tell clients: start the PA before you sign the offer, not after the SPA. Drafting, signing abroad, couriering, stamping and High Court registration all take time, and if you start late they eat into the completion period and you end up paying late interest. Once the transaction documents are drafted, have your lawyer check the PA’s scope covers every one of them.

What should a property power of attorney cover?

Draft it too narrowly and the donee will be unable to sign some document mid-deal; too broadly and it invites misuse. This is the checklist I go through with lawyers:

  • Overseas sellers: the seller must file the RPGT return (CKHT 1A) within 60 days of the sale. That’s your own obligation, so appoint a tax agent or lawyer; rates are in selling property & RPGT.
  • Overseas buyers: your lawyer retains 3% or 7% from the deposit for LHDN; see the subsale transfer process.
  • Foreign buyers: MOT stamp duty on residential property is a flat 8% from 2026, and Johor adds a state approval levy of 3% or RM30,000, whichever is higher.

Signing from overseas (for example, Singapore)

Risks of using a power of attorney, and six ways to limit them

The core risk is simple: what the donee signs, you have legally signed. This is what I advise clients:

  • Cover one named property, with its address and title number.
  • Set an expiry date, or revoke it once the deal is done.
  • When selling, state a minimum price or price range.
  • Require sale proceeds to be paid only into the donor’s own bank account, never collected by the donee.
  • Choose someone you trust completely; if in doubt, appoint a lawyer or require two people to sign jointly.
  • Keep the original PA with your lawyer, not the agent or the buyer, and ask for regular updates.
If the other side uses a PA: have your lawyer check that it is stamped and registered at the High Court, that its scope covers this transaction, and that the donor is alive and hasn’t revoked it. If anything looks off, get written confirmation from the donor directly.

How to revoke a power of attorney

A revocable PA can be cancelled by the donor at any time without the donee’s consent. Have your lawyer prepare and process the revocation, and notify the donee, the lawyers, banks and agents involved in writing so nobody keeps relying on the old document.

An irrevocable PA, given for valuable consideration and expressly stated to be irrevocable, can’t be revoked without the donee’s consent, so be sure you really need one before signing.

The seller is overseas. Who handles the RPGT?

Can an attorney sign the bank's loan documents?

Ask the bank first. Banks differ on whether an attorney may sign the loan agreement and charge: some insist the borrower signs personally, others accept a registered specific PA but want to vet the wording. Raise it before your lawyer drafts the PA, so the required powers go in from the start. Discovering the gap later means stamping and registering a fresh PA.

What extra costs does a foreign buyer face in Johor?

The PA itself is only a signing tool; the costs sit in the transaction. Stamp duty on the transfer of residential property by a foreigner is a flat 8% from 1 January 2026, with 0.5% on the loan agreement.
