CCC in Malaysia and Vacant Possession: What Must Be in Place Before You Collect Keys

A CCC in Malaysia (Certificate of Completion and Compliance) is what makes a building legally fit to occupy: without it, a developer cannot hand you vacant possession (VP) under the statutory SPA, and you should not move in. Strata units have one more condition — the strata title must already be issued at VP. This guide sets out the five VP conditions, what you pay at handover, which documents to collect, and which forms not to sign.

Short answer

A CCC (Certificate of Completion and Compliance) certifies a building is legally fit to occupy. Since 12 April 2007 it has replaced the CFO and is issued on Form F by the Principal Submitting Person. Under the statutory SPA a developer cannot deliver vacant possession without it, and strata units also need the strata title issued. Thirty days after the VP notice you are deemed to have taken possession.

Key points in 30 seconds

What is a CCC in Malaysia, and how is it different from a CFO?

From 12 April 2007, amendments to the Street, Drainage and Building Act replaced the local-authority Certificate of Fitness for Occupation (CFO) with the Certificate of Completion and Compliance (CCC). The big change is that the CCC is self-certified by the building professionals rather than approved item by item by the council.

Before issuing a CCC the PSP needs clearances covering water, electricity, sewerage, lifts and machinery, roads and drainage, and fire services. A PSP who certifies falsely faces penalties that PropertyGuru puts at up to RM250,000 and/or 10 years’ jail.

Partial CCC (Form F1): large projects may get partial CCCs so completed phases can be occupied first. PropertyGuru’s view is that a partial CCC on its own does not satisfy the VP conditions in the statutory SPA. If the developer calls you to collect keys on a partial CCC, have your lawyer confirm it covers your unit.

What conditions must be met for vacant possession?

The statutory SPA lists what must be in place before the developer lets you into possession (Schedule G cl. 26(1); Schedule H cl. 27(1)):

Delivery includes handing over the keys and must be supported by the CCC. Nothing in the statutory SPA allows occupation before the CCC, and iProperty notes that occupying a building without a CCC is itself an offence.

Strata title must come with VP

The Strata Titles (Amendment) Act 2013, in force from 1 June 2015, brought in “strata title with VP”: developers need a Certificate of Share Unit Formula (SiFUS) before selling any parcel and must apply for the Certificate of Proposed Strata Plan (CPSP) within set deadlines. Once the strata title is issued, the developer must transfer it to the buyer within 30 days. That’s why the current Schedule H ties the 17.5% VP instalment to the strata title. What collecting keys before the CCC costs

Taking the keys before the CCC is issued hands the developer the argument that vacant possession was delivered that day, and LAD stops at VP. On a RM500,000 unit at the statutory 10% a year, that is about RM4,167 a month. Occupying a building with no CCC is also an offence in itself, and insurance and utility accounts can stall.

What happens after the notice of vacant possession? The 30-day rule

When the developer is ready it serves a Notice of Vacant Possession. Under the statutory SPA (Sch G cl. 26(3); Sch H cl. 27(3)), 30 days after the notice is served you are deemed to have taken VP, whether or not you have collected the keys. Example: a notice served on 1 July 2026 means deemed VP on 31 July 2026.

Louis’s note: When the notice arrives, check three things: the CCC’s date and reference, that water and electricity are genuinely ready for connection, and — for strata — that the strata title has been issued. If anything is missing, ask the developer in writing rather than relying on a sales rep saying it’s “almost done”.

Advance charges example: assume a 1,000 sq ft unit at RM0.30 psf, so RM300 a month in service charge plus a 10% sinking fund of RM30 — RM330 a month, or RM1,320 for four months. Your developer’s notice will state the actual rate; the rules are in maintenance fees and sinking fund.

Louis’s note: The VP instalment comes from your bank, and banks take time. If the developer withholds keys because “the bank hasn’t paid yet”, get your lawyer and bank to chase it together. What the SPA requires you to have paid is what is due.

Key collection checklist: what to bring and what to get

Bring

  • Your IC (both owners for a joint purchase, or a power of attorney).
  • The VP notice and a copy of the SPA.
  • Payment for advance charges and deposits (ask which methods are accepted).
  • Inspection kit: masking tape, torch, spirit level, socket tester, phone camera.

Collect

  • A copy of the CCC (note its date: the tribunal’s 12-month LAD deadline runs from it).
  • A list of keys and access cards; count them.
  • The defect complaint form, how to submit it and the developer’s contact person.
  • Photos of the water and electricity meter readings.
  • Warranty details for appliances, locks and fittings.
  • For strata: the house rules (by-laws), renovation rules and deposit terms from the management office.
Louis’s note: The key acknowledgement should only confirm you received the keys. If it says you “accept the unit as is” or “waive all claims”, don’t sign it — ask the developer to amend it. Taking the keys does not affect your right to claim defects during the DLP or your LAD.

Common handover problems and what to do

How to verify a CCC

The simplest way is to ask the developer for a copy and check the project name, lot number and date. According to iProperty, the PSP must deposit copies of the CCC and all Form Gs with the local authority and the relevant professional boards, so if in doubt you can also ask the council (in Johor Bahru, MBJB, MBIP and so on); whether it will give you a copy depends on the council.

Louis’s note: When I go with clients to collect keys, the first thing I check isn’t the door — it’s the CCC date. It fixes both where LAD stops and when the 12-month tribunal deadline starts.

What comes after vacant possession?

  1. Inspect and list defects: submit your first defect list promptly — see defect inspection and DLP.
  2. Utilities and local taxes: open accounts, update the council’s records and register with management — see after getting the keys.
  3. Renovation: get management or council approval first — see renovation permits and rules.
  4. Title and charge: the transfer and the bank’s charge are perfected later — see caveats and perfection of transfer.
  5. Management body: the developer must convene the JMB’s first AGM within 12 months of VP — see the Strata Management Act.
  6. LAD: if delivery was late, claim at the Tribunal for Homebuyer Claims within 12 months of the CCC.

Can the developer call me to collect keys on a partial CCC (Form F1)?

It depends what the Form F1 covers. Large projects often get partial CCCs so finished phases can be occupied first, but PropertyGuru’s view is that a partial CCC on its own does not satisfy the VP conditions in the statutory SPA. Ask to see the Form F1 and have your lawyer confirm it covers your block and unit number. If it does not, hold off and put your question in writing.

Should I sign a key acknowledgement that says I accept the unit as is?

No, ask for it to be amended. The form you sign at handover should do one thing: confirm you received the keys and documents. Wording such as ‘accepts the unit in its present condition’ or ‘waives all claims’ gives away rights before you have inspected properly. Taking the keys does not otherwise affect your 24-month defect rights, covered in defect inspection and the DLP.

Does LAD keep accruing after I collect the keys?

No. Late-delivery damages run up to the VP date, and if you never collect, up to the deemed VP date 30 days after the notice was served. So two dates matter: the VP date fixes where LAD stops, and the CCC date starts the 12-month deadline for claiming at the homebuyer tribunal. Always take a copy of the CCC at handover and note the date on it.

Can I submit more defects after handover day?

Yes. The defect liability period runs 24 months from VP, and you can notify defects in writing at any point in it, with the developer required to repair within 30 days of your written notice. In practice, submit twice: an obvious-defects list on handover day, then a second list after a month or two of actually running the taps, showers and power points. Keep proof of each submission.
