Six things about Elements Garden worth knowing before you enquire
Four are reasons a Butterworth buyer would shortlist it. Two are things to settle first. All six come from the government register, the developer’s own website or my straight-line measurements.
Finished ten months before the contractual deadline
The register shows the first sale and purchase agreement dated 9 May 2016, which set the latest delivery date at 9 May 2019. The certificate of completion and compliance is dated 6 July 2018, with no extension requested or approved. For a buyer judging the developer, that is a clean delivery record on this project.
A small community: 112 condominiums in one block
Elements Garden is 120 homes in total — a single 14-storey block of 112 units and a row of 8 terrace houses. Set against a tower of several hundred units, that means fewer neighbours sharing the lifts, the car park and the management budget.
Three condominium layouts, about 1,104 to 1,459 sq ft
The developer’s floor plans show Type A at about 1,104 sq ft with three bedrooms (36 units), Type B at about 1,273 sq ft with three bedrooms (36 units) and Type C at about 1,459 sq ft with four bedrooms (40 units), each with two bathrooms. The eight link houses are drawn at about 2,700 sq ft over three floors. The register records a single 103 sq m (about 1,109 sq ft) for the condominiums and 253 sq m for the houses, so check the title area of the unit you are viewing.
Hospital, Chinese school and the ferry hub within 3.2 km
Straight-line from the registered coordinates: Bagan Specialist Centre 940 m, SJK(C) Kwang Hwa 1.1 km, SMJK Chung Ling Butterworth 2.1 km, Sunway Carnival Mall 2.8 km and Penang Sentral 3.2 km. KOMTAR in George Town is 5.9 km across the channel.
Tenure is not published by the developer
Oriental Max Group’s current website lists Elements Garden under its past completed projects by name only. Its earlier project page and brochure, preserved in a public web archive, published the floor plans, master layout, location map and artist’s impressions shown on this page and described the scheme as gated and guarded, but stated no tenure. Property portals fill that gap; I do not repeat portal claims. I will confirm tenure from the strata title, and which facilities are in use today from the management office.
It is an eight-year-old resale: check the building, not the brochure
Every home here now changes hands on the secondary market. Before you commit, ask for the management corporation’s accounts and sinking fund balance, whether the strata title for the unit has been issued, the car park lots attached to it, and the state of the lifts and waterproofing. I will get those answers in writing.

The register files Elements Garden as two components under one project code: 112 flats / condominium units in a 14-storey building at 103 sq m, and 8 three-storey terrace houses at 253 sq m. Bedroom and bathroom counts are not recorded for either. The public unit list carries 80 entries — 75 condominiums and 5 terrace houses — all marked sold; the other 40 homes are not itemised there, so the list cannot tell you which units the developer may still hold.
What the permit band meant — and what it means for a foreign buyer today
The advertising permit recorded RM364,000 to RM515,000 for the condominiums and RM787,000 to RM907,000 for the terrace houses. Each is the band on the advertising permit, not the price of any unit, and it dates from the original sale; it says nothing about today’s resale values. Seberang Perai’s floor for a foreign individual buying a strata home is RM500,000, so the condominium band straddles it and eligibility is decided unit by unit at the agreement price. For a landed-strata house the floor is RM1,000,000. State consent, the 3% levy and the flat 8% stamp duty for non-citizens apply.
Schedule H, 36 months, no extension
Both components were sold under Schedule H, the strata form of agreement, with the standard 36-month delivery period. The first agreement is dated 9 May 2016, giving a latest delivery date of 9 May 2019. The register answers ‘Tidak’ (no) to whether the period was amended. That history matters to a resale buyer only as evidence of how the developer performed.
100% built, certificate dated 6 July 2018
Both components are recorded as ‘Siap Dengan CCC’ — completed with the certificate of completion and compliance — dated 6 July 2018. The register does not show a vacant possession date. The last advertising permit ran from 2 May 2018 to 1 May 2019 and has not been renewed, which is normal once a project is finished.
About Oriental Max Group
Oriental Max Group describes itself as a property developer founded in 1994 and working in Penang and the northern region of Peninsular Malaysia, from landed housing and high-rise residences to commercial and industrial schemes. Its office address is in Kampung Telok, Butterworth, about as local to Raja Uda as a developer can be.
Its website lists Elements Garden under ‘Our Past Completed Projects’, alongside De Garden, Central Way and Seri Berapit. The current project list is mostly landed housing schemes and industrial parks — Taman Merbau Indah, Bandar Bestari Permai, Sungai Bakap Industrial Park — with UL Residence and Vi Residence among the high-rise names.
On the register, the licence for Elements Garden belongs to Lifetime Property Sdn Bhd. The same licensee’s De’Garden Homes in Seberang Perai Selatan — 73 three-storey terrace houses — is also recorded as completed with its certificate, in October 2017, and likewise without an extension.
One honest caveat: the developer’s current website no longer has a project page for Elements Garden, and no brochure is on file with the register. The drawings and artist’s impressions on this page come from the developer’s earlier project page and brochure, preserved in a public web archive from 2016 to 2018; they show the scheme as it was marketed, not as it stands today. Tenure is stated nowhere in that material. Treat any detail you read elsewhere as unverified until it is in a title search or a document from the management.

Is Elements Garden freehold?
The developer’s website does not state the tenure and the housing register does not record it, so I will not assert it here. Property portals describe the scheme one way or another, but a portal is not a title.
Tenure is settled by the strata title itself. Before you pay anything, I will get a copy of the title or have your solicitor run the land search, which also shows any charge or restriction on the unit.
What are the unit sizes at Elements Garden?
The developer’s floor plans show three condominium layouts: Type A at about 1,104 sq ft with three bedrooms, Type B at about 1,273 sq ft with three bedrooms and Type C at about 1,459 sq ft with four bedrooms, all with two bathrooms. The link houses are drawn at about 2,700 sq ft on land of about 1,500 to 2,500 sq ft.
The register records one figure for the condominiums, 103 sq m or about 1,109 sq ft, and 253 sq m for the three-storey terrace houses. For a resale unit the reliable figure is the area on the strata title; ask me for the title area of the unit you are viewing.
Can foreigners buy at Elements Garden?
Possibly, depending on the price of the unit. On the mainland a foreign individual may buy a strata home only at RM500,000 or above, and a landed-strata house at RM1,000,000 or above. The original permit band for the condominiums was RM364,000 to RM515,000, which straddles the strata floor, so eligibility is decided unit by unit at the agreement price.
A foreign purchase also needs state consent, a 3% state levy on approval and the flat 8% stamp duty for non-citizens, and the home cannot be resold for three years. Tell me the unit and I will check it against the rules before you make a commitment.
When was Elements Garden completed?
The certificate of completion and compliance is dated 6 July 2018 for both the condominium block and the terrace houses.
That was ten months ahead of the latest delivery date under the first agreement, 9 May 2019, and the register shows no extension. Today the building is a little over eight years old.
Which unit should I pick — a condominium or one of the terrace houses?
The condominiums are the mainstream choice: 112 homes in the 14-storey block, in three layouts from about 1,104 to 1,459 sq ft on the developer’s plans. Compare floors for noise from the Raja Uda roads, check which side takes the afternoon sun, and look at the distance from the lift lobby.
The 8 three-storey terrace houses are a rarity — 253 sq m each, more than twice the condominium size — and seldom come up. They are held under the same strata scheme, so they share the management and pay its charges. If one is available, ask me for the title details first.
What is the price and the maintenance fee?
The only public price information is the government permit band from the original sale: RM364,000 to RM515,000 for the condominiums and RM787,000 to RM907,000 for the terrace houses — the band on the advertising permit, not the price of any unit. Resale asking prices change with each owner and I will not repeat figures from property portals.
The maintenance charge and sinking fund are set by the management body and are not published. Message me and I will send the units currently available with the charges in writing.
How does Elements Garden compare with De’Garden Homes?
Same licensee, very different product. De’Garden Homes is 73 three-storey terrace houses of 211 sq m in Seberang Perai Selatan, 24.2 km away in a straight line, completed in October 2017. Elements Garden is a town-centre scheme: 112 condominiums of 103 sq m plus 8 terrace houses, completed in July 2018.
Both were finished without an extension on the register. If you want a landed house and do not need Butterworth, De’Garden is the comparison. If you want to live within 3.2 km of Penang Sentral, Elements Garden is the one.
Is Raja Uda practical for daily life or for renting out?
For daily life: Bagan Specialist Centre is 940 m away in a straight line, SJK(C) Kwang Hwa 1.1 km, the Sri Uda morning market 1.8 km, SMJK Chung Ling Butterworth 2.1 km, Lotus’s Bagan Ajam 2.3 km and Sunway Carnival Mall 2.8 km. Raja Uda itself is one of Butterworth’s best-known areas for hawker food and kopitiams.
For renting: demand in this part of Butterworth comes from hospital staff, families who want the Chinese schools, and people commuting to the island through Penang Sentral, 3.2 km away. I do not quote rental figures; ask me what comparable units in the block are let for today.
